Notice is hereby given that on 30 August 2018, the Western Cape Provincial Department of Environmental Affairs and Development Planning (DEA&DP) granted Environmental Authorisation (EA) for the Section 24G Application for the Unlawful Upgrading and Realignment of an existing unsurfaced farm access road on portion 4 and 7 of Farm 264, Dollas Down, Arniston in terms of the National Environmental Management Act 107 of 1998, and the Environmental Impact Assessment Regulations, 2014 (as amended). This authorisation was signed by the DEA&DP on 30 August 2018 and issued to the applicant on 31 August 2018.
The granting of the EA is subject to a number of conditions, which, along with the reasons for the decision, are set out in the EA attached to this email.
In terms of the National Appeal Regulations, 2014, and the EA, any person wishing to appeal against the decision must submit an appeal to the Appeal Administrator (see below), and forward a copy of the appeal to all registered Interested and Affected Parties (I&APs), any Organ of State with interest in the matter, and the decision-maker within 20 calendar days from the date that I&APs were notified of the decision (i.e. by 25 September 2018).

Regulatory requirement: A Basic Assessment process in terms of the 2010 Environmental Impact Assessment (EIA) Regulations is being followed for this application. EIA activities – Government Notice (GN) No.R544: Listing Notice (LN) 1:11, 18, 22, 23 and GN No. R546: LN3:4, 12, 13 & 16 and in terms of the 2014 EIA Regulations - GN No. R983:LN1:12 & 19 and GN. No. R985:LN3:4. As such authorisation from the competent environmental authority, namely the Provincial Department of Environmental Affairs & Development Planning via the EIA process is necessary.
