 NOTIFICATION OF ENVIRONMENTAL AUTHORISATION 

Rectification Application for the Unlawful upgrading and realignment of an existing unsurfaced access road on Portions 4 and 7 of Farm No. 264 and infilling of the road within 100 meters of the High Water Mark Arniston DEA&DP Reference No:E18/2/3/2/2-Dollas Down Farm 24G & 14/1/1/E2/6/2/3/0016/13/RG2-267

Notice is hereby given that on 30 August 2018, the Western Cape Provincial Department of Environmental Affairs and Development Planning (DEA&DP) granted Environmental Authorisation (EA) for the Section 24G Application for the Unlawful Upgrading and Realignment of an existing unsurfaced farm access road on portion 4 and 7 of Farm 264, Dollas Down, Arniston in terms of the National Environmental Management Act 107 of 1998, and the Environmental Impact Assessment Regulations, 2014 (as amended). This authorisation was signed by the DEA&DP on 30 August 2018 and issued to the applicant on 31 August 2018.

The granting of the EA is subject to a number of conditions, which, along with the reasons for the decision, are set out in the EA attached to this email.

In terms of the National Appeal Regulations, 2014, and the EA, any person wishing to appeal against the decision must submit an appeal to the Appeal Administrator (see below), and forward a copy of the appeal to all registered Interested and Affected Parties (I&APs), any Organ of State with interest in the matter, and the decision-maker within 20 calendar days from the date that I&APs were notified of the decision (i.e. by 25 September 2018).

Project proposal: Mr. P. De Wet is proposing to establish 19 single residential erven inlcuding internal roads and infrastrucutre on an erf approximately 1.5902 hectares in extent. Access will be taken from Lumley Avenue.

Regulatory requirement: A Basic Assessment process in terms of the 2010 Environmental Impact Assessment (EIA) Regulations is being followed for this application. EIA activities – Government Notice (GN) No.R544: Listing Notice (LN) 1:11, 18, 22, 23 and GN No. R546: LN3:4, 12, 13 & 16 and in terms of the 2014 EIA Regulations - GN No. R983:LN1:12 & 19 and GN. No. R985:LN3:4. As such authorisation from the competent environmental authority, namely the Provincial Department of Environmental Affairs & Development Planning via the EIA process is necessary.

Wet: Kennis geskied hiermee van 'n Publieke Deelname proses en aansoek om Omgewingsmagtiging kragtens die Omgewings-invloed Bepaling (OIB) Regulasies (Desember 2014) afgekondig kragtens die Nasionale Wet op Omgewingsbestuur (Wet 107 van 1998) soos gewysig. Die voorgestelde prospekteerings aktiwiteite val binne Aktiwiteit 19, 20, 22, & 27 van Staatskennisgewing R983 en Aktiwiteit 19 & 21 van Staatskennisgewing R984. 'n Volledige Bestekopname /Omgewingsinvloed bepaling Proses sal dus uitgevoer word. Kennis geskied ook kragtens die Nasionale Wet op Omgewingsbestuur: Afval, (NEM:WA), 2008 (Wet 59 van 2008) vir 'n aansoek vir 'n afvalbestuurslisensie (Kategorie A: Aktiwiteit 15). Kennis geskied ook kragtens die Wet op Minerale en Petroleum Hulpbronne Ontwikkeling (Wet 28 van 2002) vir die aansoek vir 'n prospekteerreg.

 

Braaf Environmental Practitioners (Braaf), onafhanklike Omgewings-invloed Bepaling Konsultante, is aangestel om hierdie Omgewing-invloed Bepaling (OIB) en Publieke Deelname Proses uit te voer.

 

Publieke deelname:Belanghebbende en Geaffekteerde Partye (B&GPe) word uitgenooi om deel te neem aan die publieke deelname proses deur kommentaar te lewer op die Konsep Omvangbepalingsverslag wat vanaf 23 Junie 2017 beskikbaar is by die Garies Publieke Biblioteek, Hoofpad, Garies vir 'n tydperk van 30 dae en op die projek webtuiste: www.braafsa.com (Documents for Comment – Swartdoring). Skriftelike indiening vir en/of teenkantings rakende die OIB en Afvalbestuurslisensie aansoeke kan ingedien word binne 'n periode van 30 dae wat op 24 Julie 2017 sluit. Indiening moet vergesel word van u naam, kontak besonderhede en 'n aanduiding van enige direkte besigheid-, finansiële-, persoonlike- of ander belangstelling in die aansoek.
